West and Zampella Accuse Activision of Using a Wall Hack in Contentious Legal Battle
West and Zampella Cry Foul in Lawsuit Against Activision
If this were a game of Call of Duty: Modern Warfare 2, team Jason West and Vince Zampella would be rage quitting after getting mercilessly pummeled by airstrikes and attack helicopters from team Activision. In the ongoing legal battle between the publisher and the creators of the Call of Duty franchise, West and Zampella allege Activision is intentionally drawing out the case in an effort to cause financial and professional havoc.
In December, Activision pulled rival publisher Electronic Arts into the quagmire, alleging EA sought to help West and Zampella steal the CoD franchise from Activision. Now, in the latest legal filing by West and Zampella (obtained by Kotaku), the pair claim Activision knew about EA's alleged involvement in the case six months ago and intentionally waited until December to amend the case in an effort to delay the beginning of the trial, which was slated to kick off in May.
West and Zampella state that the already lengthy lawsuit, which the pair first filed in March 2010, has already cost them more than what they are making in combined salaries at their new studio, Respawn Entertainment, and work at the studio has been severely impacted due to the case.
"Any delay of the trial in this lawsuit would increase the financial and non-financial burdens and would continue to distract us from running our business and earning a living," West and Zampella state in their legal filing.
The Los Angeles Superior Court is set to rule on how and when the case will proceed later this month.
